TERMS AND CONDITIONS (DISTANCE CONTRACT)

1. General Provisions

1.1. The seller of the goods offered in this online store is SIA “Dāvana Tev”, registration No. 40203464989, legal address: Emmas street 5-105, Riga, LV-1015, Latvia (hereinafter – Seller).

1.2. The person placing an order (hereinafter – Buyer) enters into a distance contract with the Seller.

1.3. The Seller undertakes to sell and deliver the goods in accordance with the order, and the Buyer undertakes to pay for and accept the ordered goods.

1.4. By placing an order, the Buyer confirms that they have read and agree to these Terms and Conditions.

2. Ordering and Payment

2.1. The Buyer places an order via the online store LaNiko.eu.

2.2. Payment methods: online banking (Klix by Citadele), bank transfer, ESTO3 installment payment, ESTO financing.

2.3. The invoice is issued electronically and is valid without a signature.

2.4. Payment processing is handled by the respective payment service providers.

2.5. The Seller does not store full payment card details.

3. Prices

3.1. All prices are indicated in euros (EUR).

3.2. The Seller is not a value-added tax (VAT) payer.

3.3. The Seller reserves the right to change prices without prior notice. The price valid at the time of placing the order applies.

4. Payment Terms

The currency used for payments on the website is Euro (EUR).

The Buyer can choose the following payment methods provided by the payment platform
MakeCommerce.lv, operated by Maksekeskus AS:

  • Latvian online bank payments: Swedbank, SEB, Citadele, and Luminor
  • Estonian online bank payments: Swedbank, SEB, and Luminor
  • Lithuanian online bank payments: Swedbank, SEB, and Luminor
  • Finnish online bank payments: Aktia, Ålandsbanken, Danske Bank, Handelsbanken, Nordea, Oma Säästopankki, Pohjola, POP Pankki, S-Pankki, and Säästopankki
  • Visa / Mastercard card payments

Important: When using online banking payment methods, please confirm the order and click the button “Return to Merchant”.

Personal data necessary for payment processing is transferred to the licensed payment institution Maksekeskus AS.

The contract enters into force upon successful payment to the online store’s bank account. If, for any reason, the order cannot be fulfilled, the Buyer will be informed accordingly and the paid amount will be refunded as soon as possible, but no later than within 14 days after receiving the notification.

5. Delivery

5.1. Orders are processed on working days from 9:00 to 15:30.

5.2. Orders are dispatched as soon as possible, usually within 1–2 working days after payment is received.

5.3. Delivery time depends on the selected delivery method and is usually 1–4 working days. For custom-made orders, delivery may take up to 15 working days.

5.4. Delivery is carried out via Omniva, Latvijas Pasts, Unisend, or courier services.

5.5. Delivery costs are specified during checkout.

5.6. Free delivery: in Latvia for orders over 60 EUR, in Lithuania and Estonia for orders over 70 EUR (parcel lockers).

5.7. Delivery times are indicative and may vary depending on logistics providers.

5.8. The Seller is not responsible for delivery delays caused by the Buyer or third parties.

5.9. The Buyer may specify a different delivery address or recipient.

6. Discounts

6.1. Discounts apply to products available on the website unless stated otherwise.

6.2. Discounts cannot be combined unless explicitly stated.

6.3. Custom orders (e.g., color, size, or design changes) may not be eligible for discounts.

6.4. Discount codes are applied according to the specific promotion terms.

7. Right of Withdrawal

7.1. The Buyer has the right to withdraw from the purchase within 14 calendar days from the day of receiving the goods.

7.2. The withdrawal notice must be sent to: laniko.eu@gmail.com.

7.3. The Buyer must return the goods without undue delay, but no later than 14 days after submitting the withdrawal notice.

7.4. The Seller shall refund the paid amount within 14 days from receiving the withdrawal notice but may withhold the refund until the goods are received or proof of return is provided.

7.5. Return shipping costs are borne by the Buyer.

7.6. The Buyer is responsible for any diminished value of the goods if they have been used beyond what is necessary to inspect their nature, characteristics, and functioning.

7.7. The right of withdrawal does not apply to custom-made goods and other cases specified by law.

8. Return Conditions for Jewelry

8.1. Jewelry items may be returned within 14 calendar days in accordance with withdrawal conditions.

Important:

  • If the product has a security tag or seal, it must not be removed, damaged, or cut. In such cases, the Seller has the right to refuse the return or reduce the refund amount.
  • The product must not be used beyond what is necessary for inspection. If the product is used or damaged, the Seller has the right to refuse the return or deduct compensation for loss of value.
  • The product must be complete and in a condition suitable for resale.
  • If return conditions are met, the refund is issued using the same payment method used for the purchase, unless otherwise agreed.
  • Return shipping costs are covered by the Buyer.
  • Delivery costs are not refunded, except in cases where the product is defective or does not match the order.

9. Defective or Non-Conforming Goods

9.1. If the product is defective or does not match the order, the Buyer must contact the Seller immediately.

9.2. The Seller ensures replacement or refund in accordance with applicable laws.

10. Data Processing

10.1. Buyer’s personal data is used for order processing and delivery.

10.2. The Buyer agrees to receive notifications related to the order.

10.3. If the Buyer has given consent, they may receive marketing messages, including reminders about incomplete purchases.

10.4. The Buyer may withdraw consent at any time.

11. Dispute Resolution

11.1. Disputes are resolved through negotiations.

11.2. If no agreement is reached, disputes shall be resolved in the courts of the Republic of Latvia.

11.3. The Buyer has the right to submit a complaint to the Consumer Rights Protection Centre (PTAC).

12. Copyright

12.1. All content on LaNiko.eu is the property of SIA “Dāvana Tev”.

12.2. Use of content without written permission is prohibited.

13. Final Provisions

13.1. The Seller reserves the right to amend these Terms and Conditions.

13.2. Changes take effect upon publication on the website.
